SALES TERMS

By placing an order via this website you warrant that you are of legal age to form a binding contract. You undertake to provide true, accurate, current and complete information about yourself as prompted by the website's registration form/s. 

You agree to accept responsibility for all activities that occur under your account or password.

The color of fabrics as depicted online cannot be guaranteed by Asamani Fabrics due to elements beyond our control such as variances in computer monitor settings. We will do our best to accurately describe our products, however, if you are unsure whether the color, weight, style, grain or pattern of any of our fabrics we strongly recommend ordering a sample before purchasing. 

We will endeavor to supply all orders placed and accepted on the website, however, order placement and acceptance do not constitute an obligation on us to supply until you receive confirmation of your order from us.

 

ELECTRONIC COMMUNICATIONS

When you visit Asamani Fabrics or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

REFUND POLICY

All sales are final. We do not offer refunds or exchanges for incorrect purchases or change of mind once the fabric has been cut. Please follow the care instructions as outlined in the product description as we are unable to accept claims on fabrics that have been laundered incorrectly. The color of fabrics as depicted online cannot be guaranteed by Asamani Fabrics due to variances beyond our control such as computer monitor settings. In the unlikely event that we have sent you the wrong fabric or you find that your fabric is faulty, we will replace the fabric at no charge or if we are unable to do this due to the product being unavailable we will refund both the fabric cost and the shipping fee (if applicable).

All claims on faulty items must be made within 14 days of purchase & proof of purchase must be provided.  To make a claim please email us at asamanifabrics@gmail.com

SHIPPING TERMS FOR FABRICS

All our fabrics are sent from France/ Czech Republic. We use La Poste and Ceska posta services. You have a choice of standard or tracked services and we will supply your tracking number once your order has been dispatched. Please pay attention when choosing domestic service for Happy-Post you have a choice of home delivery or relais. When placing orders bigger than offered postage please contact us and we will calculate the best possible shipping price.

RISK OF LOSS

All items purchased from Asamani Fabrics are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

 

PRODUCT DESCRIPTIONS

Asamani Fabrics and its associates attempt to be as accurate as possible. However, Asamani Fabrics does not warrant that product description or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Asamani Fabrics itself is not as described, your sole remedy is to return it in unused condition.

DISPUTES

Any dispute relating in any way to your visit to Asamani Fabrics or to products you purchase through Asamani Fabrics shall be submitted to confidential arbitration in France, except that, to the extent you have in any manner violated or threatened to violate Asamani Fabrics intellectual property rights, Asamani Fabrics may seek injunctive or other appropriate relief in any state or federal court in the state of France, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the French Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

GERMANY - VERPACKUNGSGESETZ (LUCID PACKAGING REGISTER)

On January 1, 2019, Germany’s Packaging Act (VerpackG) came into effect, imposing requirements on online retailers (including Etsy shops) selling to buyers in Germany. The Packaging Act promotes the recycling and reuse of packaging materials (e.g. cardboard boxes, tape, and bubble wrap).

My company Asamani Fabrics is registered with LUCID, which is the Packaging Register of the Stiftung Zentrale Stelle Verpackungsregister (Foundation Central Agency Packaging Register – ZSVR).

Producers/distributors pay a license fee to the dual system for the collection, sorting and recycling of the packaging they introduced to the market. My Dual System partner is Activate by Reclay.

Please separate the packaging and recycle it when you can. Thank you.
